The Personal Injury Protection Order of Priority for Motorcycle will be different than auto effective 7/2/2020.
Motorcycle Order of Priority
1. Insurer of the owner/registrant of the motor vehicle.
2. Insurer of the operator of the motor vehicle.
3. Insurer of the operator of the motorcycle.
4. Insurer of the owner/registrant of the motorcycle.
If there is no personal auto policy in the order of priority the claim can be filed with Michigan Assigned Claim Plan with a $250,000 Benefit Limit.
An injured motorcyclist’s No-Fault medical benefits are limited by whatever coverage the motorist has selected – which could be $50,000, $250,000, $500,000 or unlimited. If any in the order of priority have PIP benefits but the limit is below $250,000, the motorcyclist cannot still go to the Michigan Assigned Claim Plan to collect the difference. However, the motorcyclist will be able to sue the at-fault driver for excess medical benefits beyond the coverage the driver selected.T
